SMS Terms

These Text Messaging Terms of Use (“SMS Terms”) govern text messaging between you and The Hwood Group, LLC (doing business as “h.wood Group”). By opting in to or using a Text Message Service (as defined below) from The Hwood Group, LLC, you accept these SMS Terms.

This agreement is between you and The Hwood Group, LLC or one of its affiliates. All references to “h.wood Group,” “The h.wood Group,” “we,” “our,” or “us” refer to The Hwood Group, LLC, 9229 West Sunset Boulevard, Suite 900, West Hollywood, CA 90069.

1. About This Service (Program Description)

The h.wood Group’s Text Message Service is a conversational, person-to-person messaging service: individual h.wood Group employees use their individual business phone numbers to exchange one-to-one text messages with guests regarding reservations, private events, and guest services at our restaurants and venues.

Messages are initiated by you (the guest) or sent by an h.wood Group employee in the course of serving you — for example, confirming or adjusting a reservation, coordinating event details, or responding to a question you asked.

This service is not used for marketing or promotional blasts, bulk messaging, automated alerts, or auto-dialed messages. Message frequency varies. Message and data rates may apply.

Definitions

“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS or successor protocols or technologies).

2. Supported Messaging

The service supports SMS text messages only. MMS (picture/multimedia) messages are not supported.
The service is available to United States mobile phone numbers only.

3. Consenting to Text Messages

You may opt in to receive text messages from us in any of the following ways:

By providing your mobile number and agreeing to be texted — for example, when you make a reservation or plan an event with us in person, over the phone, or through a web form, and you agree (verbally or by an optional, unchecked checkbox on the form) that we may text you about it; or
By texting us first — sending a text message to an h.wood Group employee’s business number constitutes your consent to receive conversational replies from us in that conversation.

By consenting to receive text messages from us, you agree to these SMS Terms, as well as our Terms of Use and Privacy Policy, which are incorporated herein by reference.

Consent is not a condition of purchase. You are not required to agree to receive text messages to make a reservation, attend an event, or purchase any goods or services from us.

4. E-Sign Disclosure

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

5. Message Frequency

Message frequency varies. This Text Message Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).

6. Cost of Text Messages

We do not charge you for the messages you send and receive via this Text Message Service. However, message and data rates may apply — depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

7. Help and Support

For help at any time, reply HELP to any text message from us, or contact us at privacy@hwoodgroup.com or +1 310-859-1011.

8. Opting Out of Text Messages

If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or otherwise notify us by any reasonable means (including by contacting privacy@hwoodgroup.com). After you unsubscribe, we may send you one final text message confirming your opt-out; you will receive no further messages from that number unless you opt back in (for example, by replying START).

Because this is a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. Opting out of messages from one employee’s number stops messages from that number; if you wish to stop receiving text messages from The h.wood Group entirely, contact us at privacy@hwoodgroup.com and we will opt you out across all of our numbers.

We honor all opt-out and consent-revocation requests within 10 business days of receipt (and typically immediately).

9. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and network availability.

10. Text Message Service Privacy Policy

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.

11. Quiet Hours

As a matter of policy, h.wood Group employees will not initiate text messages to you before 8:00 a.m. or after 9:00 p.m. in your local time zone (and not before 8:00 a.m. or after 8:00 p.m. for recipients in Florida). If you text us outside these hours, we may reply to your message or respond the following day.
